The United States Patent and Trademark Office (USPTO) has released its latest data as of March 2025, revealing significant trends in patent filings, examination backlogs, and examiner staffing. These insights benefit inventors, entrepreneurs, and startups navigating the patent law landscape.


Surge in Unexamined Patent Applications

As of March 2025, the USPTO's inventory of unexamined utility, plant, and reissue (UPR) patent applications has reached a record high of 830,020. This marks a substantial increase from 793,824 in FY2024 and 742,919 in FY2023. 


Implication: Applicants should anticipate longer wait times for initial examination. To mitigate delays, consider strategies like the Track One Prioritized Examination Program, which can expedite the review process


Steady Growth in Patent Filings

Patent application filings continue to rise, with 600,540 UPR applications filed in FY2024, up from 597,631 in FY2023. 


Implication: The increasing volume underscores the importance of a well-prepared and strategically crafted patent application to stand out in a crowded field.


Rise in Requests for Continued Examination (RCEs)

The number of pending RCEs has grown to 17,447 as of March 2025, up from 13,659 in FY2024.


Implication: A rising RCE inventory indicates challenges in the examination process. Applicants may need to engage in multiple rounds of correspondence with examiners, emphasizing the need for clarity and precision in initial filings.


Examiner Workforce and Productivity

The USPTO employs 8,516 patent examiners as of March 2025, a slight decrease from 8,599 in FY2024. The average number of actions per disposal remains steady at 2.4, indicating consistent examiner workload.


Implication: While examiner staffing remains robust, the high volume of applications may impact examination timelines. Applicants should be prepared for potential delays and plan accordingly.


Patent Allowance Rates

The allowance rate for UPR applications, including RCEs, stands at 60.2% as of March 2025. Excluding RCEs, the rate is higher at 80.1%.
